Why Make A Cohabitation Agreement?

To cohabit means to live together without any legal documentation binding you to do so.

A cohabitation agreement is designed for couples wishing to live together and regulate their finances in order to protect themselves from unnecessary cost and litigation should their cohabitation break down. It will bind both of you legally to the terms of the agreement.

Some parts of the agreement can be overturned by a court is you have children. This agreement assumes that if a child is born during cohabitation the party with the larger amount of capital will provide support to the child whether the child is resident with them or not. This of course would depend on the amount of capital available to the non-resident parent.

The agreement also assumes that unless you have specified otherwise in this agreement or in another written documentation that you intend all assets to be divided equally.
